TERMS OF SERVICE

1. Who we are
This website, shoptoothily.com, is operated by Go Global Wellness LLC, a Florida
limited liability company, doing business as Toothily ("Toothily", "we", "us").
Our contact details are at the end of these terms.

2. Agreement
By browsing or buying from this site you agree to these terms, along with our
Return and refund policy, Shipping policy, Purchase options cancellation policy,
and Privacy policy, all of which are part of these terms. If you do not agree,
please do not use the site.

3. Eligibility
You must be at least 18, or the age of majority where you live, to place an
order. By ordering you confirm you meet that requirement and that the payment
method is yours or you are authorized to use it.

4. Your account
You are responsible for keeping your account access secure and for activity
under your account. Tell us promptly at contact@shoptoothily.com if you think
someone else has access.

5. Products and descriptions
We describe our products as accurately as we can. Toothily brushes have a Moso
bamboo handle with soft bristles. Bamboo is a natural material, so grain, color,
and tone vary from brush to brush. Screen colors vary too. Neither is a defect.

Engraved brushes are offered in themes. You choose the theme. The individual
message within that theme is a surprise and cannot be selected, previewed, or
exchanged for a different message.

6. Pricing and availability
Prices are shown in US dollars and can change without notice. Products can go
out of stock or be discontinued at any time.

We try to keep the site accurate, but errors happen. If a product is listed at a
clearly incorrect price or with an incorrect description, we may cancel the
order even after it is confirmed. If we do, we refund you in full and email you
to explain.

7. Orders
Your order is an offer to buy. We accept it when we ship it. We may refuse or
cancel any order, including for suspected fraud, resale without authorization,
quantities beyond normal household use, or an obvious pricing error. If we
cancel, we refund you in full.

8. Subscriptions
Subscriptions renew automatically until cancelled and are governed by our
Purchase options cancellation policy. Please read it before subscribing.

9. Shipping and risk
Shipping terms are in our Shipping policy. Risk of loss passes to you on
delivery. If a package is lost, stolen, or damaged in transit, our Shipping
policy tells you how we handle it.

10. Returns
Returns and refunds are governed by our Return and refund policy.

11. Wholesale and custom engraving
Wholesale orders and custom engraving orders are not sold through this site and
are not covered by these terms. They are governed by the separate terms and
minimums agreed in writing for that order. Retail terms, including the happiness
guarantee, do not apply to them.

12. Using the products safely
Replace your toothbrush every three to four months, or sooner if the bristles
look worn or frayed. Rinse it after use and let it dry in the open air.

Toothily brushes are consumer oral care products. They are not medical devices,
and nothing we publish is medical or dental advice. For anything concerning your
oral health, talk to your dentist or doctor.

Keep brushes away from children under three, and supervise young children while
they brush.

13. Marketing messages
If you opt in, we may send you marketing email or text messages. Every marketing
email has an unsubscribe link. Reply STOP to any text to stop texts. Message and
data rates may apply. Transactional messages about an order or subscription are
not marketing and will still be sent.

14. Our content
Everything on this site, including the Toothily name, logo, text, photography,
and design, belongs to us or our licensors and is protected by copyright and
trademark law. You may not copy, republish, or use it commercially without our
written permission.

15. Content you submit
If you send us a review, photo, or comment, you keep ownership of it and grant
us a non-exclusive, royalty-free, worldwide license to use it in our marketing
and on our site, with credit where appropriate. Only submit content you have the
right to share. We may remove anything unlawful, misleading, or abusive.

16. Prohibited use
Do not use this site to break the law, to scrape or copy it at scale, to
interfere with its operation, to introduce malicious code, or to impersonate
anyone.

17. Third-party links
We sometimes link to sites we do not control. We are not responsible for their
content or their practices.

18. Disclaimer
The site and products are provided "as is" and "as available". To the fullest
extent the law allows, we disclaim implied warranties of merchantability,
fitness for a particular purpose, and non-infringement. We do not warrant that
the site will be uninterrupted or error-free. Some jurisdictions do not allow
these exclusions, so parts of this section may not apply to you. Nothing here
limits rights you have under consumer protection law that cannot be waived.

19. Limitation of liability
To the fullest extent the law allows, our total liability to you for any claim
relating to the site or a product is limited to the amount you paid for the
order that gave rise to the claim. We are not liable for indirect, incidental,
or consequential damages. Some jurisdictions do not allow these limits, so they
may not apply to you.

20. Indemnity
You agree to indemnify us against claims arising from your breach of these terms
or your misuse of the site.

21. Governing law and where disputes are heard
These terms are governed by the laws of the State of Florida, without regard to
its conflict of laws rules. Any dispute will be brought in the state or federal
courts located in Pinellas County, Florida, and we both consent to those courts.

If you live in Canada, nothing in these terms limits consumer protection rights
you have under the law of your province, including any right to bring a claim
locally.

We are not asking you to give up your right to go to court or to join a class
action. If you have a problem, email contact@shoptoothily.com first. We will try
to sort it out with you directly.

22. Changes
We may update these terms. The version posted here when you order is the version
that applies to that order. Material changes to subscription terms are emailed
to active subscribers in advance.

23. Severability and entire agreement
If any part of these terms is unenforceable, the rest still applies. These terms
and the policies referenced in them are the entire agreement between us.
